1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, AI agents, platforms, marketplaces, integrations, content, features, and related services provided by Insideware Apps LLC, operating as FuelQ Labs (“FuelQ Labs,” “Insideware Apps,” “we,” “us,” or “our”).

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

These Terms apply to FuelQ Labs and its products, including but not limited to FuelQ Pro, Valen Health, Ryvelo, Drops, SmartDump.AI, APOS Platform, and future products operated by Insideware Apps LLC.

2. Our Services

FuelQ Labs builds AI-powered products, agents, platforms, marketplaces, and research-driven systems across sports science, health, nutrition, human performance, mobility, commerce, learning, and enterprise intelligence.

Our services may include:

• AI nutrition and hydration planning
• Race-day strategy and performance guidance
• Health, wellness, and lifestyle coaching agents
• WhatsApp, web, voice, image, and mobile AI experiences
• Training, recovery, sleep, and performance insights
• Marketplace, booking, rental, and commerce tools
• Learning, knowledge management, and summarization tools
• Workforce intelligence, operational dashboards, and business visibility platforms
• Data integrations with third-party platforms, devices, and services
• Other current or future products operated by FuelQ Labs or Insideware Apps LLC

Some services may be experimental, beta, limited-release, or research-oriented. We may modify, suspend, or discontinue any feature or service at any time.

3. Eligibility

You must be at least 13 years old to use our services.

If you are under the age of majority in your jurisdiction, you may use our services only with the involvement and consent of a parent, guardian, school, team, organization, or other authorized adult.

By using our services on behalf of a company, team, organization, marketplace seller, coach, or other entity, you represent that you have authority to bind that entity to these Terms.

4. Account Registration

To access certain features, you may need to create an account or authenticate through a third-party service.

You agree to provide accurate, complete, and current information.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Promptly notifying us of unauthorized access or security issues
• Ensuring your use of connected third-party services complies with their terms

We may suspend or terminate accounts that contain false information, violate these Terms, create security risks, or misuse the services.

5. User Content and Data

You may submit, upload, connect, transmit, or generate content through our services, including but not limited to text, chat messages, voice inputs, images, files, meal photos, training data, health or fitness data, business data, product listings, marketplace content, documents, feedback, and other materials (“User Content”).

You retain ownership of your User Content.

By submitting User Content, you grant Insideware Apps LLC and FuelQ Labs a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, process, reproduce, display, transmit, adapt, and analyze your User Content solely as needed to:

• Provide and operate the services
• Generate AI outputs, recommendations, plans, summaries, insights, and responses
• Improve, secure, debug, and maintain the services
• Develop new features and product capabilities
• Comply with legal obligations
• Enforce these Terms

You represent that you have all rights and permissions necessary to submit or connect User Content to our services.

You are responsible for the accuracy, legality, and appropriateness of your User Content.

6. AI Outputs and Recommendations

Our services may generate outputs using artificial intelligence, machine learning, rules-based systems, predictive models, and automated personalization.

These outputs may include nutrition plans, hydration guidance, training insights, recovery suggestions, race strategies, summaries, dashboards, operational insights, learning content, product recommendations, or other responses.

AI-generated outputs may be incomplete, inaccurate, outdated, or inappropriate for your specific circumstances. You are responsible for reviewing and deciding whether to rely on any output.

You should not treat AI outputs as professional medical, nutritional, legal, financial, safety, emergency, or other regulated advice.

We do not guarantee that AI outputs will be accurate, safe, complete, reliable, or suitable for your needs.

7. Health, Fitness, Nutrition, and Performance Disclaimer

FuelQ Labs services related to health, fitness, nutrition, hydration, weight management, training, recovery, sleep, injury prevention, or performance are provided for informational, educational, coaching, and decision-support purposes only.

They are not intended to replace professional medical advice, diagnosis, treatment, nutrition therapy, physical therapy, emergency care, or professional coaching.

Always consult a qualified healthcare provider, registered dietitian, medical professional, physical therapist, certified coach, or other qualified professional before making significant changes to your diet, training, medication, injury recovery, weight management, or health-related routines.

Do not use our services for medical emergencies. If you believe you are experiencing a medical emergency, call emergency services immediately.

8. No Medical Provider Relationship

Use of our health, nutrition, performance, or wellness services does not create a doctor-patient, dietitian-client, therapist-client, coach-athlete, or other professional relationship between you and FuelQ Labs, Insideware Apps LLC, or any of our service providers.

FuelQ Labs does not practice medicine, provide medical diagnosis, prescribe medication, or provide emergency medical services.

9. Third-Party Integrations and Platforms

Our services may connect to or rely on third-party platforms, APIs, devices, data providers, payment processors, messaging platforms, cloud providers, AI providers, analytics tools, or other services.

These may include, but are not limited to:

• Garmin
• Strava
• TrainingPeaks
• Dexcom
• Apple Health
• Google Fit
• WhatsApp / Meta services
• Payment providers
• Cloud infrastructure providers
• AI model providers
• Analytics and communication providers

Your use of third-party services is governed by their own terms and privacy policies.

We are not responsible for third-party services, data availability, errors, outages, permissions, security, policies, fees, or actions.

You may need to authorize access to third-party services. You are responsible for managing and revoking those permissions as needed.

10. Marketplace, Commerce, and Rental Services

Some FuelQ Labs products, including Ryvelo and Drops, may support marketplace, commerce, rental, booking, seller, vendor, owner, or customer interactions.

Unless otherwise stated, FuelQ Labs provides technology infrastructure and does not own, inspect, guarantee, manufacture, prepare, deliver, rent, or sell the products, services, food items, bicycles, equipment, listings, or offerings made available by third-party users, sellers, owners, vendors, or businesses.

Users, sellers, owners, vendors, and customers are responsible for:

• Accuracy of listings and descriptions
• Pricing, availability, and fulfillment
• Compliance with applicable laws and regulations
• Safety, quality, maintenance, food handling, permits, taxes, insurance, and local requirements
• Resolving disputes related to their transactions
• Their own communications, agreements, and conduct

FuelQ Labs may provide tools, payments, messaging, booking flows, or dispute support, but we are not a party to transactions between users unless expressly stated.

11. Enterprise and Business Services

Some services, including APOS Platform and related enterprise intelligence tools, may process business, workforce, operational, or organizational data.

If you use our services on behalf of an employer, customer, client, team, or organization, you are responsible for ensuring that:

• You have authority to submit or connect the data
• Your use complies with applicable laws, contracts, policies, and employment obligations
• Required notices, consents, or permissions have been obtained
• Sensitive, confidential, or regulated data is handled appropriately

FuelQ Labs provides decision-support tools and does not guarantee business outcomes, employment decisions, operational performance, compliance, or risk elimination.

12. Subscriptions, Payments, Trials, and Billing

Certain services may require payment, subscription, usage fees, marketplace fees, transaction fees, or other charges.

If you purchase a paid service, you agree to pay all applicable fees, taxes, and charges.

Subscription services may automatically renew unless canceled before the renewal date.

Free trials may convert to paid plans if billing information is provided and the trial is not canceled before the trial ends.

Prices, plan features, limits, and billing terms may change over time. We will provide notice when required by law.

Payments may be processed by third-party payment providers. We do not store full payment card details unless explicitly stated.

Refunds, if any, are provided at our discretion or as required by law.

13. Acceptable Use

You agree not to misuse our services.

You may not:

• Violate any applicable law, regulation, contract, or third-party right
• Submit false, misleading, harmful, illegal, or infringing content
• Use the services for medical emergencies, diagnosis, or treatment decisions without professional oversight
• Use the services to generate or distribute harmful, abusive, discriminatory, defamatory, violent, sexual, or unlawful content
• Upload malware, viruses, or harmful code
• Attempt to gain unauthorized access to systems, accounts, data, or infrastructure
• Reverse engineer, scrape, crawl, copy, or exploit the services except as permitted by law
• Interfere with or disrupt the operation or security of the services
• Use the services to build competing models, datasets, or services in violation of these Terms
• Misrepresent affiliation with FuelQ Labs or Insideware Apps LLC
• Use automated systems to abuse, overload, or manipulate the services
• Submit data you do not have the right to use
• Use our services for surveillance, unlawful profiling, or discriminatory decision-making

We may investigate and take action against violations, including suspension, termination, content removal, or legal action.

14. Intellectual Property

The services, software, designs, interfaces, algorithms, models, workflows, databases, logos, trademarks, graphics, text, code, product names, content, features, and functionality are owned by Insideware Apps LLC, FuelQ Labs, or our licensors.

These materials are protected by U.S. and international copyright, trademark, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from our services unless expressly authorized.

FuelQ Labs, FuelQ Pro, Valen Health, Ryvelo, Drops, SmartDump.AI, APOS Platform, and related names, logos, and marks are brands, trademarks, or product names operated by Insideware Apps LLC.

15. Feedback

If you provide feedback, suggestions, ideas, improvements, bug reports, or product requests, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

We may use feedback to improve existing products or develop new products.

16. Beta, Experimental, and Research Features

Some services or features may be labeled beta, preview, experimental, research, early access, or limited release.

These features may be unstable, incomplete, inaccurate, changed, suspended, or discontinued at any time.

You use beta or experimental features at your own risk.

17. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information.

18. Service Availability and Changes

We may modify, update, suspend, limit, or discontinue any part of the services at any time.

We do not guarantee uninterrupted access, uptime, data availability, third-party integration availability, or error-free operation.

We are not liable for service interruptions, delays, data loss, integration failures, outages, or changes to third-party platforms.

19. Disclaimers

The services are provided “as is” and “as available,” without warranties of any kind.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and security.

We do not warrant that:

• The services will meet your expectations
• AI outputs will be accurate or appropriate
• Recommendations will improve health, performance, business, or financial outcomes
• The services will be uninterrupted, secure, or error-free
• Data from third-party integrations will be complete, accurate, or available
• Marketplace users, sellers, vendors, owners, or customers will perform as expected

20. Limitation of Liability

To the fullest extent permitted by law, Insideware Apps LLC, FuelQ Labs, and their owners, officers, employees, contractors, affiliates, partners, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, personal injury, business interruption, reputational harm, or loss of goodwill.

Our total liability for any claim related to the services will not exceed the amount you paid to us for the service giving rise to the claim in the twelve months before the claim arose, or USD $100, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless Insideware Apps LLC, FuelQ Labs, and their owners, officers, employees, contractors, affiliates, partners, service providers, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

• Your use or misuse of the services
• Your User Content
• Your violation of these Terms
• Your violation of applicable law or third-party rights
• Your transactions, listings, products, services, rentals, or marketplace activity
• Your use of AI outputs or recommendations
• Your business, team, or organizational use of the services

22. Termination

We may suspend or terminate your access to the services at any time if we believe you have violated these Terms, created risk, caused harm, failed to pay fees, misused the services, or used the services unlawfully.

You may stop using the services at any time.

Termination does not affect rights or obligations that arose before termination, including payment obligations, intellectual property rights, disclaimers, limitations of liability, indemnity, and dispute provisions.

23. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

24. Dispute Resolution

Before filing a claim, you agree to first contact us at legal@fuelqlabs.com and attempt to resolve the dispute informally.

If a dispute cannot be resolved informally, disputes will be handled in the state or federal courts located in Alameda County, California, unless otherwise required by applicable law.

You consent to the personal jurisdiction and venue of those courts.

25. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you by email, in-app notice, website notice, or other appropriate means.

The updated Terms will be posted with a new effective date.

Your continued use of the services after updated Terms become effective means you accept the updated Terms.
